CITY OF SOUTH LAKE TAHOE ADOPTS NEW VACATION RENTAL ORDINANCEEarlier this month the South Lake Tahoe City Council adopted new regulations for obtaining vacation home rental
(VHR) permits. This new ordinance will take effect October 1, 2015.
The ordinance only affects properties within the city limits of South Lake Tahoe. The County areas from Montgomery Estates down Pioneer Trail into Meyers and Tahoe Paradise are not affected. Mountain View Estates is also not affected.
Under the new system VHR applicants will be required to have the property inspected for health and safety compliance. Non-conforming or illegally existing aspects of the property will be evaluated. Also, neighboring property owners within a 300 foot radius will be notified of the application.
Neighbors will have 10 days to send back any objections to the VHR for review by a Zoning Administrator (ZA). If no objections are received the ZA will review the application and the inspection report and ask the applicant for any additional information necessary towards granting the permit.
If objections are received the ZA will schedule a public hearing to hear input from the neighbor(s), as well as input from the applicant or the applicant's representative.
The City Manager tells us that the objections must be specific to the property for the ZA to consider denying the application, not just a blanket statement in opposition to VHRs.
Factors that will be considered are the residential character of the neighborhood, the density of VHRs already immediately surrounding the new VHR property and the past complaint history of the property.
There will also be an annual renewal process which will include review of any complaint history or additions to the property allowing for more guests.
The City tells us that the application process should take no longer than 30 days, and can run concurrent with an escrow period in the case of a pending sale to a prospective VHR buyer.
